Upsies Terms of Use

Last updated: 5 November 2026

These terms are a contract between you and Samarpit Santoki (samarpit.santoki@gmail.com) ("we", "us"). They apply when you use the Upsies website at upsies.samarpit.dev and the Upsies Android and iOS apps (together "Upsies", "the app"). If you do not agree, do not use the app.

1. Who can use Upsies

You must be 13 or over. If you are under the age of adulthood where you live, a parent or guardian must agree to these terms for you. The app is not designed for children under 13.

The app asks your age when you first open it. The web game asks at "save progress". Do not give a false age. If you are under 13, you cannot use Upsies.

2. Your licence

We give you a personal, non-exclusive, non-transferable and revocable licence to use the app on devices you own or control, for your own non-commercial fun.

You must not:

3. Game content

We try hard to get the facts right, but we can make mistakes, and facts change. Upsies is entertainment. Do not rely on it for facts that matter. If you see a wrong question, use the report button.

The Q's jokes about your score are part of the game. Please do not take them personally.

4. Your account and saved progress

The app creates an anonymous account for you, through Google Firebase. There is no sign-in. Your streak, Chalk and scores are saved on our servers against that account. Cosmetics and your level are saved only on your device. Scores are checked by the server. We can remove scores that look like cheating.

If you lose the anonymous account, your progress can be lost. For example, this happens when you uninstall the app, or when you clear site data in your browser. We cannot get it back.

You can move a web streak to the app once with a link code. Link codes end after 30 days, and only part of a large Chalk total moves.

You can delete your account in Settings, or at https://upsies.samarpit.dev/delete with your delete code. Deletion is permanent. Your Chalk, streak and scores are gone, and we cannot restore them. Purchases stay with your store account.

5. Chalk, cosmetics, levels, streaks and scores

Chalk, cosmetics, levels, Streak Freezes, streaks, best scores, Ladder ranks and similar items are game features. They have no money value. You earn Chalk by playing, and you can spend it in the game on items such as cosmetics and Streak Freezes. You cannot buy Chalk with real money. You cannot sell these items, trade them or exchange them for cash. You own no property in them.

We can change or reset how these features work.

6. Purchases

Remove Ads is a one-time in-app purchase. It turns off ads on the store account you bought it with. Use Restore purchase in Settings to get it back on a new device. The web game has no purchases.

Google Play or the Apple App Store takes your payment, and their rules on refunds apply. Nothing here limits your legal rights as a consumer. When you buy digital content, you may lose a right to cancel once the content starts.

7. Ads and data

The free app shows ads, including optional ads that give a reward. The web game has no ads. We do not control the content of each ad. If you see a bad ad, tell us.

The game sends usage events, as our Privacy Policy explains. That policy also explains how ads use data.

8. Duels and boards

Boards, the Ladder and duels show your player label, score and rank to other players. We can remove you from a duel, a board or the Ladder.

Duel links end after 7 days. Anyone with a link can see a duel's results, so share links with care.

9. Our rights

The app, its name, the Q character, the art, sounds, text and code belong to us or to our licensors. These terms do not give you any right to them, other than the licence in section 2. Factual data in the game comes from public sources, listed where the licence needs it.

When you share a result, you are free to post your score text and grid.

10. Feedback

If you send us ideas or reports, we can use them for free. We do not have to use them.

11. Changes and ending

We can change, pause or stop the app, or any part of it, at any time. We can end your licence if you break these terms. You can stop at any time by deleting your account and uninstalling the app.

We can update these terms. We will change the date at the top. If a change is important, we will tell you in the app or on the store listing. If you keep using the app, the new terms apply to you.

12. No warranty

We give you the app "as is" and "as available". As far as the law allows, we make no promise that it will always work, will be free of errors, or will suit your purpose.

13. Limit of liability

As far as the law allows, we are not liable for indirect or consequential loss, or for lost data, lost streaks or lost Chalk. Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or USD 10, whichever is higher.

Nothing in these terms limits liability that the law does not let us limit, such as for death or personal injury caused by negligence, or for fraud. Nothing here takes away your legal rights as a consumer.

14. Apple App Store users

If you got the app from the App Store: these terms are between you and us, not Apple. Apple has no duty to support the app and is not responsible for claims about it. If the app fails to meet a warranty, you can tell Apple, and Apple may refund the purchase price. Apple has no other warranty duty. We, and not Apple, deal with any claim that the app breaks someone's intellectual property rights. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them. You confirm that you are not in a country under a US embargo and are not on a US restricted-party list.

15. Law

The laws of India apply. You keep any consumer rights your own country gives you.
